Terms of Service
These Terms of Service (“Terms”) outline the conditions under which Naráic Físeán Limited (“we”, “our”, or “the Company”) provides photography, videography, drone, floor plan and related media services (“Services”) to clients (“you” or “the Client”). By booking or receiving services from Naráic Físeán Limited, you agree to be bound by these Terms.
Scope of Work
All work to be completed will be outlined in advance through a written agreement, email confirmation, or invoice. The deliverables (photographs, videos, floor plans, etc.) will be provided as specified in the agreed scope.
Any additional requests, revisions or changes beyond the agreed scope may incur additional charges which will be communicated before work continues.
Delivery of Work
Initial deliverables will be provided within the timeframe communicated at the point of booking. Delivery times may vary depending on project size, access to the property and any delays caused by the Client.
If the Client requires further revisions, these must be requested within 14 days of receiving the final deliverables, unless otherwise agreed. Additional revisions beyond what was initially agreed may incur additional costs.
Client Responsibilities
The Client is responsible for:
Providing accurate information regarding the property and access arrangements.
Ensuring the property is prepared, tidy and ready for shooting at the agreed time.
Communicating all required shots or details before or during the shoot where possible.
Confirming any revisions within a reasonable timeframe.
If requested shots cannot be taken due to environmental, safety, or access issues, the Company will deliver the closest suitable alternative at their professional discretion.
Payment Terms
All invoices must be paid within the payment window stated on the invoice (typically 7 calendar days unless otherwise agreed). Delivery of final files may be withheld until initial deposit or full payment is received, depending on project type.
Late Payment Policy
If payment is not received by the due date stated on the invoice:
A late payment fee of £35 will be applied automatically.
Interest may be charged on overdue balances at the statutory rate permitted under the Late Payment of Commercial Debts (Interest) Act 1998 (currently 8% plus the Bank of England base rate), calculated daily until payment is received.
Discounted or goodwill pricing previously applied may be revoked if payment becomes overdue. In such cases, the invoice will be amended to reflect the original, undiscounted rate.
Continued non-payment may result in:
Suspension of ongoing or future services, including revisions.
Referral to a debt recovery agency, for which the Client will be liable for all associated costs.
By using our services, the Client acknowledges and agrees to the above late payment structure.
Revisions Policy
Included revisions will be detailed in the agreed scope of work. Additional revision requests (such as alternate edits, colour grades, reshoots, or additional versions) may be billed separately unless explicitly included.
Further revisions beyond the initial included set will only be performed after all outstanding invoices have been fully settled.
Usage Rights
The Client is granted a non-exclusive licence to use the delivered media for marketing, advertising, listing, or internal business use. Copyright remains with Naráic Físean Limited unless transferred in writing.
Media may not be sold, redistributed, significantly altered, or licensed to third parties without written permission.
Naráic Físean Limited reserves the right to use any captured media for promotional purposes unless the Client requests otherwise in writing prior to delivery.
Cancellations and Rescheduling
Cancellations made within 24 hours of the scheduled shoot time may incur a fee.
If weather, safety concerns, or access restrictions prevent completion of the shoot, the Company may reschedule at its discretion.
Liability
Naráic Fíean Limited will exercise reasonable skill and care in delivering services. However, we are not liable for:
Delays caused by circumstances beyond our control (e.g., weather, access issues).
Losses arising from incorrect property information provided by the Client.
Indirect or consequential losses.
Drone services are performed only in accordance with legal and safety requirements. Flights may be cancelled or altered if conditions do not meet regulatory standards.
Governing Law
These Terms are governed by the laws of England and Wales. Any disputes shall be resolved in the appropriate courts of England and Wales.
